Can Anyone Use a Deed Poll to Change Their Name?
There are very few limits regarding changing your name in the UK. However, certain circumstances will stop you from legally being able to do so or require you to notify specific bodies when doing so. Examples are as follows:
Age
To legally change your name via deed poll independently in the UK, you must be over the age of 16. Changing your name before that age will require written consent from those with parental or guardian responsibilities for you.
Mental Capacity
To execute your deed poll legally and for it to be valid, you must have mental capacity. This means that you understand entirely the decision you are making and what is expected of you during and after the process. You need to be capable of making decisions solely without being impaired or influenced by anyone else. Everyone is assumed to have the mental capacity to change their name using a deed poll unless indicated or proven otherwise. Reasons to believe you do not have mental capacity include:
- If you appear not to understand the decision you are making
- If you seem unable to retain the information
- If you do not understand the consequences of the decision
- If you cannot communicate your decision
Bankruptcy and Debt
A person who is un-discharged bankrupt or subject to a debt relief order may still be able to change their name legally using a deed poll, but they must notify their official receiver, and when conducting business under their new name, they must inform them of their name at the point of bankruptcy.
Criminal Issues
If you are in the process of criminal proceedings or you have a criminal history involving particular crimes, then you must immediately notify the police and your local police station of your intention to change your name. If you are on probation, then you must inform your probation officer.
